On Saturday 1 October 2022 Philip Warford is speaking to families and carers at the Wolfram Syndrome Conference 2022 about Planning for the Future with Wills & Trusts and Decision Making.

Philip will talk to families about how they can protect a disabled son or daughter if they are no longer there to care for them using carefully prepared Wills and Trusts. Some people may already have a standard Will in place, but often do not realise that leaving inheritance to a disabled person could impact their means tested benefits or make them at risk of financial abuse.

Philip will also be discussing Decision Making at this event. He will talk about when a vulnerable or disabled child turns 18. The fundamental principle of the Mental Capacity Act is that no one has the right to make decisions on behalf of a person when they turn 18. The reality of this is not so clear for a disabled or vulnerable person as they may be able to make certain day to day decisions, but struggle to understand other more complex decisions about their finances and welfare.

When a person is unable to make such decisions their mental capacity is questioned, Philip will explain the principles around mental capacity and what families and carers need to consider. Philip will talk about Powers of Attorney and the legal appointment of another person to make decisions on behalf of an individual with a disability. Philip will also talk about the Court of Protection, who they are and what they do. Becoming a Deputy for a disabled or vulnerable person, the timescales and the costs.
